Netflix and OpenAI become the latest Big Tech companies sued for ‘engineering addiction’
As expected, the legal strategy that successfully smoked Meta and YouTube in April — and Big Tobacco decades earlier — is expanding its battlefront against big tech
On Monday, Netflix lawyers visited the state courthouse in Collin County, Texas, arguing that a deceptive trade practices suit filed against the streaming company by State Attorney General Ken Paxton should be tossed out based on jurisdiction alone — a state court in Dallas suburb McKinney can’t rule on decisions made by executives 1,700 miles away in Los Gatos, Calif.
Per pay-walled Puck, Netflix law fighters largely “kept their powder dry,” refusing to reveal much about their legal strategy against the suit, which they privately believe “lacks merit” and is largely based on “distorted information.” Autoplay, the feature at the heart of the lawsuit, which transitions viewers, including kids, to the next installment in a series without them having to touch a button, can easily be disabled, Netflix argues. And parents have many other controls over what their children watch on the platform.

As for the oft-embattled Paxton, after receiving a Donald Trump endorsement that likely helped vanquish incumbent U.S. Sen. John Cornyn in last month’s GOP primary, the controversial AG finds himself down in the polls early to Democratic rival James Talarico. It’s easy to dismiss a lawsuit against a streaming company largely viewed as “woke” by MAGA as a mere red-meat distraction for Paxton’s far-right constituents.
Netflix, however, was wise to conserve its legal ammo — it faces real legal peril here.
